Request to correct an error in civil registration records

Civil registration records is the set of information related to your identity and family situation: surname, first name, date of birth, place of birth, names and dates of birth of parents, name and date of birth of husband or wife, date of marriage, names and dates of birth of children.

The Ofpra produces several civil registration documentation for refugees, stateless persons and beneficiaries of subsidiary protection: the birth certificate , the marriage certificate and the family record book .

If there is an error on these documents, it is possible to request that it be corrected. This is called a "civil registration documentation rectification".

You need to contact the Paris court, or more rarely the Ofpra.

- If the error is on the residence permit, which is different from the birth certificate: it is the prefecture that must correct the residence permit; there is no need to contact the OFPRA.
- If the error is on the birth certificate of a child born in France: it is the town hall of the place of birth that must correct the birth certificate; there is no need to contact the OFPRA.
- A family reunification application is possible even if your marriage has not been registered by the OFPRA and you do not have a marriage certificate or family record book. This does not prevent your application from being processed.
The processing time for a request to rectify civil registration documentation is several months.

How to do it?

Before submitting an application, it is important to carefully review the letter from OFPRA sent with your birth certificate. It explains the information OFPRA uses for your civil status records.
If you made a mistake in your application or if you are using a document that you did not provide to the OFPRA, you must contact the court directly (see option 2). The OFPRA will not be able to correct it: there is no point in contacting the OFPRA.

Option 1 - For simple errors or copying mistakes: contact the OFPRA

Simple errors, copying errors, or omitted information:

  • Name, surname, city of birth, city of marriage misspelled
  • Gender error
  • Information differs between the birth certificate and the marriage certificate
  • Information omitted regarding civil registration documentation.

If your situation is not in the examples above, you must contact the court (see option 2).

The French Office for the Protection of Refugees and Stateless Persons (OFPRA) can only correct simple errors or transcription mistakes between your asylum application file and your birth certificate. OFPRA cannot correct complex errors.

To ask the OFPRA to correct information, you must send a letter containing:

  • a copy of the birth certificate to be corrected
  • a copy of a document with the correct information.
Don't forget to write your OFPRA file number on the letter.
It is a 9-digit number of the type XX-XX-XXXXX written in the top left corner of each letter sent by the OFPRA.

It is advisable to make a copy of the letter and send everything in a large envelope.

Option 2 - For complex errors: contact the Paris Court

Complex errors

  • Descent error (link between a parent and a child, name of a parent…)
  • Error in a date of birth, a wedding date
  • Marriage not registered by the OFPRA
  • The information differs between your actions and the documents given to the Ofpra after the letter.  
  • Any other situation not presented as an example

For complex errors, it is pointless to contact the OFPRA.

You have to:

1 - Write a letter on a piece of paper with your OFPRA file number explaining the error to be corrected, and sign it.

2 - Add a copy of the document to be corrected, a copy of a document with the correct information, a copy of the residence permit

3 - Submit your application in person or send it by mail.

What happens next?

  • The decision is positive.

OFPRA will amend your document with a "correction note" (a short sentence explaining the change) and send a copy of the birth certificate and an extract by post to your postal address.

  • The decision is negative because the OFPRA does not have the ability to correct the document.

OFPRA will send you a letter explaining the decision.

Depending on the circumstances, you may contact the Paris District Court (see option 2).

  • The decision is positive.

The Paris district court asks the OFPRA to amend your civil registration documentation with "a corrective mention" (a short sentence to explain the change).

The OFPRA will then send the documents directly to your postal address by mail. You do not need to contact the OFPRA.

  • The decision is negative.

The Paris judicial court will send you a letter explaining the decision.
