Know and understand the essentials of labour law in France

Labour law governs all the rights and duties of workers in France. It describes :<ul><li>the different types of employment contract and the conditions for terminating them, </li><li>the rules relating to working time, salary, leave, retirement, etc.</li></ul> Labour law allows you to know and enforce your rights in the professional sphere. <ul><li>Salary: in 2021, the minimum wage is 10,25 euros/hour (gross minimum wage).</li><li> Working time: the legal working time is 35 hours per week. Any hour of overtime must be paid. In some contracts, this duration can go up to 39 hours per week. In this case, the worker is entitled to RTT (reduction of working time).</li><li> Retirement age: between 62 and 67 years old.</li><li> Leave: the legal number of holidays is 2.5 days per month worked.</li></ul> Advice<ul><li> Working hours: working hours must be respected and any absence must be justified. In the event of illness, a medical certificate must be given to the employer.</li><li> Pay slips: it is important to keep all your payslips. They are proof of your activity throughout your life and are necessary when calculating the worker's pension.</li><li> Discrimination: "distinction between persons on account of their origin, sex, family situation, pregnancy, physical appearance, surname, state of health, disability, genetic characteristics, morals, sexual orientation, age, political opinions, trade union activities, membership or non-membership, real or supposed, of a particular ethnic group, nation, race or religion" ==&gt; It is prohibited!</li></ul>

Learn the basics of labour law

In France, there are several categories of workers. Depending on the categories, the rules may be different (employment contract, rights and duties of employers and employees). Here are a few examples:<ul><li> Apprentices: they are both students and employees, they alternate between training weeks in a CFA (apprenticeship training centre) and work weeks in a company. They have an employment contract (apprenticeship contract) and a salary.</li><li> Craftsmen: they do a manual trade and are their own bosses (for examples: baker, house painter, shoemaker, hairdresser). To work, the qualified craftsman must hold a CAP (Certificate of Professional Competence — or an equivalent diploma) or have at least 6 years of professional experience in their field.</li><li> Traders: they must have a location to set up their business (shop, stall in a market, place for the installation of a truck, etc.). They can also choose to work for a commercial brand; in this case, they must purchase a franchise.</li><li> Farmers: they are their own bosses. They own or rent their land/livestock.</li><li> Civil servants: they are recruited through competitive examination, enjoy job security and are subject to civil service rules. Depending on their level of studies, they are divided into 3 categories: category A (baccalaureate + 3 years at University), category B (baccalaureat level) and category C (CAP level). Their salary depends on their level of qualification and their seniority. To be a civil servant, you must be of French or European nationality. On the other hand, it is possible to work in the public service as "contractual" without having French nationality. </li><li> Employees: they work for a public employer (State, local authorities, etc.) or private companies. They depend on the Labour Code and hold an employment contract — concluded with the employer —, which defines their missions, their salary and their working time.</li><li> Temporary employees: they work for a temporary employment agency and carry out short-term missions, either to replace an absent employee or to respond to an urgent need from the company. They have an employment contract with the temp agency and have their salary paid by the agency. The missions can sometimes be followed by a permanent recruitment from the companies.</li><li> Seasonal workers: Their contract is concluded for the season or from date to date, for a maximum period of 8 months. Examples of trades: grape harvesting, picking, mountain guide, ski instructor, etc.</li></ul> It is also possible to exercise an activity under two other somewhat separate statuses:<ul><li> Trainees: a "tripartite" agreement is signed between the trainee, the host organisation (company, association, etc.) and the educational establishment (school, university, etc.). If the duration of the internship is of more than 2 months (consecutive or not during the same year), the intern receives a bonus every month.</li><li> Volunteers: volunteers put their time, skills and experience at the disposal of another person or organisation/association. They do not get paid but they can be reimbursed for certain expenses related to their activity (travel costs, material, etc.). Volunteers have a full-time, fixed-term contract. They are involved in a mission of general interest and receive an allowance.</li></ul>

Know your professional status

All workers must have an employment contract that is proof of their activity and guarantees their rights. This contract describes the employee's tasks and prevents abuse by the employer. Depending on the statutes, there are different contracts: <ul><li> Apprenticeship or professionalisation contract: this is a sandwich course contract between training and work in a company. It can take the form of a fixed-term (CDD) or permanent contract (CDI).</li><li> The Single Integration Contract (CUI) : this is primarily intended for people with difficulties.</li><li> The Temporary Work Contract (CTT) or Interim: this is in fact a double contracts. One contract is concluded with the employer of the company and another contract is concluded with the temporary work/interim agency. The contracts are renewed for each new assignment.</li><li> Fixed-term contract (CDD): it can last a maximum of 18 months and must contain the date of the end of the contract.</li><li> The open-ended contract (CDI): this contract does not specify the duration of the hiring and is therefore the most stable type of contract.</li></ul>

There are several ways to terminate an employment contract: The contract is for a fixed period and ends naturally, on the date of the end of the contract ==&gt; the worker receives unemployment benefit. Resignation: outside the trial period, resignation is possible if it is done in agreement with the employer or if it is linked to the employee&#x27;s incapacity ==&gt; the worker does not receive unemployment benefit, except in the absence of a notice period or if the worker has not been able to take all of their holidays. The conventional termination: this is a free agreement between the employee and the employer ==&gt; the worker receives unemployment benefit — subject to conditions. Dismissal: the employer alone terminates the contract ==&gt; when the dismissal is linked to a disciplinary reason, the worker does not receive unemployment benefit. On the other hand, if the dismissal has an economic or personal cause, the worker receives compensation. At each end of contract, the worker receives:<ul><li> a work certificate</li><li> a certificate for Pôle Emploi (Job Centre)</li><li> a settlement of all outstanding accounts</li></ul>

In this multicultural space, professionals, volunteers and other refugees occasionally help with administrative process (taxes, mails, etc.) and access to rights (lawyer, financial helps, etc.). Open 9:00 a.m. to 12:30 p.m. Monday toThursday. Good to know: Le Café des Réfugiés is only open to statutory refugees and beneficiaries of subsidiary protection living in Paris (75000). Legal support

The practice exchange meetings make it possible to share the field experiences of professionals involved in integration issues, to question their daily practices and to provide them with solutions, tools and ideas for improving these practices. Outside contributors are invited to open up the debates to other practices and allow people to discover various solutions to the difficulties observed. Depending on the themes chosen and the conditions of implementation, the project team organizes three meetings to exchange practices over two days and face-to-face per year. Practice Exchange Meetings (REP)

Open to all professionals working in connection with persons benefiting from international protection, the hotlines are a place of exchange and advice set up since the beginning of 2021. During an appointment lasting an average of 30 minutes, the professional will be able to explain a blocking situation or a request for information on defined topics. These requests will occur in the following thematic field: - Right to stay, residence permit - Civil status: issuance of documents by OFPRA, rectification of errors - Access to social rights CAF, Retirement - Employment: Employment center and right to work - Health rights: CPAM - Youth: local mission - Family reunification - Mobility and travel: travel document, movement of minors, driving license - Right to account and Domiciliation - Housing: documents required by lessors and development of the DLS for BPI - Family member: regularization parent-child refugee, refugee child, spouse - Nationality/naturalization At the end of each interview, a "Prescription" sheet containing the main issue, the problem presented, the advice provided and the reference laws will be drawn up and given to the person concerned. <a href='https://reloref.france-terre-asile.org/prestations/accompagnement-juridique-et-social/' target='_blank' class='edited-btn'>Registrations for hotline</a>Good to know: The hotlines are held every month in video due to the health situation. I have been recognised as a refugee or I have been granted subsidiary protection: am I allowed to stay in France? How do I apply for a residence permit?

If you are recognised as a REFUGEE, the prefecture will give you a:  Resident's card (valid for 10 years)  If you benefit from SUBSIDIARY PROTECTION, the prefecture will give you a:  Multi-year residence permit, with the mention "beneficiary of subsidiary protection" (valid for 4 years)

RESIDENCE PERMITS

<ul><li> Spouse: if your spouse arrived at the same time as you or arrived later through the family reunification procedure, he/she can obtain the same residence permit as you: </li><ul><li> If you are a refugee: he or she will also obtain a resident's card; </li><li> If you are a beneficiary of subsidiary protection: he/she will also obtain a multiannual residence permit. </li></ul><li> Minor child: your minor children do not have to have a residence permit. However, if they are between 16 and 18 years old and wish to work or benefit from vocational training, they can apply for a residence permit. </li><li> Adult child: at 18 years old, your children (who have reached majority) must apply for a residence permit. If they wish to remain under OFPRA protection, they must apply for asylum at the same time as they apply for a residence permit. - If the protection decision was taken by OFPRA before 01/01/2019: your children must make an appointment at the Prefecture (on location or online) in order to apply for a residence permit (10 years for refugees and 4 years for subsidiary protection). If they wish to remain refugees or under subsidiary protection, they must tell the Prefecture. - If the protection decision was taken by OFPRA after 01/01/2019: your children must make an appointment at the Prefecture (on location or online) in order to apply for a residence permit (10 years for refugees and 4 years for subsidiary protection). If they wish to remain refugees or under subsidiary protection, they must apply for asylum on their own behalf. </li><li> Parent of a BPI child : if your unmarried minor child is protected by OFPRA, you have the right to the same residence permit as him/her. </li><ul><li> If he/she is a refugee: a resident card (10 years); </li><li> If you are a beneficiary of subsidiary protection: a multi-year residence permit (4 years). </li></ul></ul>

THE RIGHT OF RESIDENCE FOR FAMILY MEMBERS&nbsp;

When you are protected by OFPRA, France grants you the right to stay on its territory. To justify your "right to stay", the prefecture gives you a "residence permit". Some members of your family may also benefit from a right of residence in order to guarantee your private and family life. On this page, you will find out how to obtain a residence permit and how to have it renewed.

As an asylum seeker, you have a certificate of asylum request. This constitues your residence permit while waiting for the OFPRA to decide on your status.

When you are an asylum seeker

When the OFPRA or the CNDA delivers a positive decision on your status, they will notify you of their decision in writing (e-mail), acknowledging your protection. You must then exchange your residence permit for a new one: <ul><li> At the prefecture : with your OFPRA/CNDA decision, your asylum request certificate, your proof of address and 3 identity photos, do ask for a receipt acknowledging the granting of international protection. </li></ul>

When you are recognised as a refugee or have subsidiary protection&nbsp;

The prefecture must give it to you within 8 days. It proves that you are protected by OFPRA and that you have the right to stay in France. This will help you for all your subsequent administrative procedures. This receipt gives you the right to work. This is clearly indicated on the receipt. You can exchange this receipt for a residence permit according to the conditions given by your prefecture. Often the conditions are the following: <ul><li> having signed the CIR (Republican Integration Contract)</li><li> having an address (you must find another domiciliation than that of your SPADA) </li><li> depending on the prefecture, having received your birth certificate issued by the OPFRA (the average time to obtain this document is 8 months). </li></ul> While waiting to receive your residence permit, you must ask the prefecture to renew your receipt before it expires.

The receipt confirms the recognition of international protection while your residence permit is pending.

When you are recognized as protected, the OPFRA will send you a letter containing a form called &quot;fiche familiale de référence&quot; (&quot;family reference sheet &quot;). You must fill it out carefully and without haste. Try to get help from a social worker or someone with experience as this form must be returned to OFPRA for them to produce your new identity documents (birth certificate, family record book, marriage certificate).   ! Good to know: if you make a mistake in filling out this form, your future civil status documents will be incorrect, which could lead to numerous blockages (with the CAF, the CPAM, the Prefecture, your employer, etc.). Correcting this error will be a long and difficult process. So do be careful when filling out the form. Get help from someone with experience, at your SPADA for example. If you have official identity documents from your country of origin, OFPRA will ask you to send them, along with the family reference sheet. This will make it easier to draw up new civil status documents.

Once your receipt has been obtained, you can request an appointment from the OFII by inquiring at your SPADA or directly at the OFII (French Office for Immigration and Integration). During this meeting, you will be offered: 
<ul>
<li> A medical visit </li>
<li> Collective information </li>
<li> An interview with an auditor </li>
<li> A prescription of social support if necessary </li>
<li> A 4-day civic training spread over 4 months </li>
<li> A language assessment and prescription of language training if necessary </li>
</ul>
 At the end of that day and of this programme, the OFII will have you sign a Republican Integration Contract (CIR). This is a way of committing yourself to respecting the principles and values of French society and to carrying out the training that will be prescribed to you.

Roughly 8 months after you have returned your family reference form to OFPRA, you will receive your new civil status documents. 
 ! Good to know: don't forget to go to the prefecture to request a residence permit. Later, if you need more recent civil status documents, you can request them on the OFPRA website (in the 'online procedures' tab).

Reception of civil status documents

The request for a residence permit was automatically generated when you requested your receipt indicating that you are a beneficiary of international protection. 
 When you have your civil status documents, you can go to the prefecture or make an appointment to collect your residence permit. It will be necessary for you to present the following documents to the prefecture: 
<ul>
<li> The signed CIR </li>
<li> Proof of address (domiciliation certificate, accommodation certificate, rent receipt) </li>
<li> Your birth certificate issued by the OPFRA </li>
<li> Your current receipt </li>
</ul>
 If the file is complete, you will receive a 10-year or 4-year residence permit, as seen above.

The renewal request must be submitted to the Prefecture at the latest 2 months before the expiration of the card.
